Defining Public Law 102-477

The Bureau of Indian Affairs is the lead federal agency for implementing the Demonstration Project created by Public Law 102-477, the Indian Employment, Training and Related Services Act, 25 U.S.C. section 3401 et seq. Under the Public Law 102-477 Demonstration Project, Tribes have the authority to integrate Federal employment, training and related services that they provide to their members. The Federal programs currently integrated into Tribal demonstration projects are administered by the Department of the Interior and include the Department of Interior, Department of Labor and the Department of Health and Human Services.  The Blackfeet Manpower One-Stop Center presently includes the following Federal Partners in our P.L. 102-477 3 Year Plan the Department of Interior (General Assistance, Job Placement and Training); the Department of Labor (Adult and Youth Employment and Training); and the Department of Health and Human Services (Temporary Assistance for Needy Families, Child Care and Development Fund, Native Employment Works and Community Service Block Grant).

Participation in the demonstration is completely voluntary. The lead Federal agency for this inter-Departmental demonstration is the Department of the Interior (DOI), Office of Indian Energy & Economic Development. Formula-funded programs in the Bureau of Indian Affairs, the Department of Labor, the Department of Health and Human Services, and the Department of Education are involved. Public Law 102-477 is permanent legislation; it has no expiration date.

Funding

There is no separate funding associated with Public Law 102-477. All the funds involved in an entity’s “477” plan are those which the entity would otherwise receive under the authority of the individual programs it chooses to consolidate in its “477” plan.

Federal Programs Affected:

Public Law 102-477 applies to any Federal formula-funded program dealing with employment, training, or any related area, that the Tribe is eligible to receive. Each participating Tribe specifies which programs will be included in its “477” plan.  On December 18, 2017, President Trump signed Public Law 115-93 that amends and expands the existing Public Law 102-477.   P.L. 115-93 changed the status of P.L. 102-477 from a Demonstration Project to permanent program status.

P.L. 115-93 added the following Federal partners for inclusion into P.L. 102-477, they are Departments of Agriculture, Commerce, Interior, Education, Energy, Health and Human Services, Homeland Security, Housing and Urban Development, Labor, Transportation, Veterans Affairs.  In order for the Tribe to include these Departments to their P.L. 102-477 Plan, the plan must be employment and training related.  With emphasis on employment.
